Comparative fault in Indiana is basically when the jury decides a case and they have their verdict form, they will decide the percentage of of each party if fault is an issue in the case. And so in Indiana, if you are more than 50% at fault, so 51% at fault, then you get zero for your verdict. But if you are 50% at fault, what happens is the jury damages award. So if it was a hundred thousand dollars that the jury determined your case was worth, it would be divided by 50%. And so then your verdict would be $50,000.
