What is the Length of a Medical Malpractice Case?
The length of a medical malpractice case in Indiana is unfortunately very unpredictable, but can also take a really long time. We have a system in Indiana where every patient is forced to go through this three physician panel. On average, it can take a couple years. So if you consider that we’re going to spend six months getting your medical records, getting you up to speed in terms of having an expert look at your case and then getting it on file, and then we’re going to spend two years in this informal medical review panel phase. We might not see a trial date for five years from now or six years from now. It’s possible. I never want that to happen, and I’m not an injury lawyer that lets moss grow on any case. So I can promise you, I’m going to be pushing your case as quickly as possible, but I also want to be realistic and say these cases don’t move fast.
